The parents of an underage athlete have filed a federal lawsuit in Portland alleging their daughter was raped by another participant in the Nike Elite Program at a Beaverton hotel over the July 4 weekend. Nike and the National Scholastic Athletics Foundation, which runs the program with Nike, are named as defendants.

The Nike Elite Program brings 40 high school track athletes (20 boys and 20 girls across all track and field disciplines) to Nike headquarters for training, events and networking. NSAF has run high school events for three decades, including Nike Outdoor Nationals.

The allegations:

– On the night of July 5, participants gathered in a hotel room provided by Nike and NSAF. After others left, the lawsuit alleges the male participant assaulted the plaintiff and physically prevented her from calling for help or leaving.

– Staff from Nike and NSAF allegedly found her crying in a hallway afterward, kept her for up to 30 minutes without her mother present, urged her to describe the encounter as consensual and required a written statement. Her mother was allegedly not allowed to read it.

– The suit alleges Nike and NSAF did not call police, and that the male athlete had prior disciplinary issues and was already in the process of being removed from the program — without other athletes or parents being warned.

– He was expelled and sent home after the incident, according to the complaint.

The legal claim is negligence for failing to provide reasonably safe conditions. The suit seeks economic and non-economic damages.

Beaverton police confirmed they are investigating.

Nike has not commented on pending litigation.

In a statement to FOX 12 in Portland, NSAF CEO Josh Rowe called the allegations serious and said the organization's first concern is for the young woman and her family. He added that NSAF disagrees with the account in the complaint and will respond through the legal process. NSAF said it would not publicly discuss either athlete.

Nike and NSAF will respond to the complaint in federal court. None of the allegations have been tested, and no charges have been filed.
